Police: Man used explicit photos to extort sex from girl
Friday, July 10, 2009

A Westmoreland County man will face a hearing in two weeks on charges that he sexually assaulted a 15-year-old girl, photographed and videotaped the incident, and used the images to extort more sex from the girl.

David Burnett, 21, of West Newton, is being held in the Westmoreland County Prison on $25,000 bail, pending a hearing set for 2 p.m. July 23 before District Judge Joseph DeMarchis in Jeannette.

According to a police affidavit that supports his arrest, Mr. Burnett first assaulted the girl in January 2008 at a residence in Jeannette. The incidents continued at various locations until last July, the affidavit said.

The pictures and videos, as well as other illegal sexual images involving minors, were found when police searched Mr. Burnett's home and computer in April.

The girl told police in March that she had a relationship with the suspect. While the two were involved, Mr. Burnett accessed her MySpace page on the Internet. He changed her passwords, preventing her from accessing her own account.

In the affidavit, police said the suspect used this method to "psychologically control the victim. He would threaten her that he would disseminate the aforementioned sexually explicit photographs through her MySpace account to attempt to get her to do what he wanted."

Police seized Mr. Burnett's computer and cell phone, recovering 10 photographs and eight movie clips of him and the girl engaged in various sexual acts, the affidavit said.

Mr. Burnett also is accused of having illegally tapped into a neighbor's wireless Internet service, using it for about four months without the neighbor's permission.

During that time, some of the sex photos were posted onto the girl's MySpace page.
